Problem

Do Any of These Sound Familiar?

"Does my business really need a trademark?"

You may think it doesn't matter for a small shop. In fact, smaller businesses face greater risk.

"I don't know who to ask"

There are very few patent attorney offices in Saga and Nagasaki, leaving many people unsure where to turn for advice.

"It seems expensive"

Registration for one class costs approximately 155,000 yen total. Compared to the cost of being forced to rebrand, it's a reasonable investment.

Real Cases

Real Cases Where "I Didn't Know" Was No Excuse

Here are actual disputes that arose from failing to register trademarks.

Case 01 — Confectionery Maker

Mon Chou Chou Case (Osaka)

51.4 million yen

A confectionery shop famous for "Dojima Roll" failed to check for prior trademarks when changing its trade name, resulting in approximately 51.4 million yen in damages and a ban on using the name.

Lesson: Always conduct a prior trademark search before changing your trade name or deciding on a brand name.
Case 02 — Global Corporation

iPad Trademark Case (China)

4.8 billion yen

Apple failed to properly investigate the "iPad" trademark in China, discovering that another company held the rights. Apple ultimately paid approximately 4.8 billion yen to settle.

Lesson: Neglecting prior research can lead to costs of staggering proportions.

We cover more cases, including a Kyushu sushi delivery chain caught in a trademark dispute.

Check

We Recommend Trademark Registration If You...

Choosing a new company or shop name?
Even if a trade name can be registered at the legal affairs bureau, it may still infringe on someone else's trademark. Searching before you decide on a name is the most reliable and cost-effective approach.

Cases Where Trademark Registration Should Be a Priority

Company & Shop Names

Your company or shop name is the face of your business. If forced to change it later, you'll need to redo signage, business cards, websites, and everything else.

Product & Service Names Used Continuously

The names of your core products and flagship services are the backbone of your revenue. If another party registers the trademark first, you may be unable to continue selling under that name.

Don't forget your flagship product names: In addition to your company name, consider registering the trademarks for your key product and service names. For example, the "Dojima Roll" confectioner was ordered to pay approximately 50 million yen in damages over the "Mon Chou Chou" name — brand name protection directly impacts revenue.
Key Point: If in doubt, consult us first. We'll help you determine whether registration is truly necessary.

FAQ

Frequently Asked Questions

How long does trademark registration take?
Typically about 8-10 months. If urgent, the "accelerated examination" system can shorten this to approximately 2 months.
Can sole proprietors register trademarks?
Yes, you can file under your personal name. No corporate entity is required. In fact, we especially recommend early registration for sole proprietors.
Can I engage your services without visiting in person?
Yes. All procedures can be completed online via Zoom or other platforms. We receive many engagements from Nagasaki, Kumamoto, and Fukuoka.
If my company name is registered at the legal affairs bureau, do I still need a trademark?
Yes. Trade name registration and trademark registration are entirely different systems. Even with a registered trade name, someone else can register the same name as a trademark.
What should I do if I receive a "notice of reasons for refusal"?
This is not a final rejection. You can submit a written opinion to argue your case within 40 days. Many applications succeed through proper responses.

Over 15 detailed FAQs and thorough explanations of the system are available on the guide page.
